A durable power of attorney may be the most important type of legal document. These documents are designed to help you during your lifetime. The durable power of attorney documents let you (the principal) select another person (the agent) to carry out your business and legal affairs, and make healthcare decisions, on your behalf, should you become mentally incapacitated. These documents are called “durable” because they remain effective even if you become mentally incompetent.

These documents may be needed more often than you expect. If you have a back injury for example which causes you to have to take narcotic pain medication, a doctor may likely rule that you are mentally incompetent to make business, legal, or healthcare decisions for yourself. Then your durable power of attorney documents would be needed. And if you or a loved one suffer from Alzheimer’s disease or some other dementia as an older adult, the proper durable power of attorney documents would need to be in place to give legal authority to the caretakers.
